Understanding Workers’ Compensation in New Jersey

The New Jersey Division of Workers' Compensation oversees all work-related injury and illness claims in the state. These claims are processed through an administrative system—not the court system—and provide coverage for a wide range of injuries and conditions, including:

  • Broken bones from workplace accidents
  • Repetitive stress injuries (e.g., carpal tunnel syndrome)
  • Illnesses caused by toxic exposure on the job
  • Aggravation of pre-existing conditions due to work activities

What Workers’ Compensation Benefits Are Available?

Temporary Total Disability

Temporary Total Disability benefits are designed for injured employees who are unable to work and need medical care. These payments are generally 70% of the employee's average weekly wage and are subject to a minimum and maximum. For 2019, the maximum is $921, and the minimum is $246.

Permanent Partial Disability

The permanent partial disability benefits are ongoing in weekly payments. The amount depends on what type of injury you have and the severity of the injury. These benefits can begin after your Temporary Total Disability benefits end.

Permanent Total Disability

If it has become clear that you will be unable to work due to a work-related injury, Permanent Total Disability benefits are available. PTD benefits are typically the same amount you were receiving for TTD. Permanent total disability is available for life.

You May Also Have a Third-Party Claim

If a third party (someone other than your employer) caused your work injury—such as a negligent contractor or equipment manufacturer—you may have the right to file a third-party personal injury claim in addition to your workers’ comp case.

At Radano Orecchia, LLC, we can help you pursue both claims, maximizing your financial recovery.
